Steps Taken To Spread Awareness Against Marriage Fraud In Canada
Marriage fraud in Canada is a growing trend for very obvious reasons. The country has been tightening some of the measures against foreign nationals planning to work in Canada and obtain permanent residence and later its citizenship. In the wake of the tightening rules and regulations, individuals are following the easier path, that of going for a marriage. There are two kinds of marriage fraud taking place in Canada. In the first case, individuals are getting married to Canadian nationals with the sole aim of obtaining an entry into the country. In this case, the victim is often left ruing a failed marriage, caused by the exploitation by the spouse.
Another case of marriage fraud in Canada is that of a marriage of convenience, where both parties enter into an understanding. In such cases, the marriages are broken as soon as the permanent residence or citizenship has been granted to the foreign national. However, stern measures are being implemented to make sure both these occurrences are prevented. Citizen and Immigration Canada office often rejects applications for permanent residence on the basis of having a spouse in the country. However, the criteria, based on which a marriage is considered fake, hasn't been revealed.
Interestingly, there is an operational manual that lists some of the questions and concerns that officials tackle while determining the authenticity of the marriage. Several questions and their answers are considered. It is checked if the individual has married and divorced multiple times. Wedding details, educational backgrounds of both individuals, guests at the wedding and social background of the individual are all considered. Thousands of applications are received each year for immigration. However, it is now considered strictly criminal to indulge in marriage purely for the reason of getting entry or residence in the country.
The government is also taking steps to enhance awareness about marriage fraud. Unsuspecting individuals naively believe in their partners without realizing that they are part of a grand plan. However, the new rules have now made it mandatory for both individuals to spend at least 2 years, from the time permanent residence was granted to the foreign national on the basis of the marriage. One of the key triggers to catch immigration marriage fraud is to identify individuals who have requested for a divorce or walked out of a marriage within a very short time of gaining entry into the country.
This kind of fraud makes Canadian citizens vulnerable to heartbreak. As part of the measures, individuals who have been victims of marriage fraud are offered emotional counseling and moral support to help them recuperate from the shock. The Canada Border Services Agency takes every step in its capacity to investigate couples who have furnished documents of marriage, with one of them applying for immigration. The new law, which requires sponsored spouses to remain in marriage for at least two years, deports individuals who don't satisfy the condition. Moreover, those who have committed fraud to acquire permanent resident status aren't allowed to sponsor anyone else for at least 5 years.
